We do not access, control, or manage your accounts or content. You must ensure that you have the necessary rights and permissions to use any content or accounts linked to our Services.
BuddyX is not affiliated with third-party platforms such as OnlyFans. We do not imply any partnership, sponsorship, or endorsement with those platforms. Content transferred to third-party platforms, such as OnlyFans, is governed solely by your agreements with those platforms.
2. Privacy
Code by Goat GmbH collects, stores, and processes personal data in accordance with applicable data protection laws and regulations. Our Privacy Policy explains how we collect and manage your data, the purposes for which it is processed, and your rights.
By using our Services, you consent to the collection, storage, and processing of your personal data as described in our Privacy Policy. We process personal data solely for the purposes outlined in that document and only share it with third parties when necessary to provide the Services or comply with legal obligations.
3. Eligibility
To access BuddyX Services, you must be at least 18 years old or have the legal capacity to enter into a binding contract under applicable laws. You must provide accurate and current information during registration and keep it updated.
If you are registering or using the Services on behalf of an agency or organization, you must be an authorized representative with the legal authority to bind that entity to these Terms.
4. Acceptable Use
You agree to the following restrictions when using BuddyX Services:
You will not engage in illegal activities or upload, post, or transmit harmful, abusive, defamatory, or otherwise objectionable content. You will not use the Services to infringe upon intellectual property or privacy rights. You will not distribute unsolicited advertising, promotional materials, or spam. You will not upload viruses, worms, or other harmful software. You will not interfere with or disrupt BuddyX's Website, Services, or network infrastructure. You will not attempt unauthorized access to BuddyX's systems or data. You will not engage in activities that violate third-party platform policies.
5. Use of Services
BuddyX grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services for personal or internal business purposes only. This license does not permit you to modify, copy, distribute, reverse engineer, or sell any content or services provided through BuddyX.
By submitting content to BuddyX, you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, display, reproduce, distribute, and modify that content for the purpose of providing our Services.
6. Payment and Refund Policy
We strive to provide the best user experience with BuddyX. Payments are securely processed through third-party providers. By subscribing to a paid plan, you authorize us to charge your payment method for the selected plan, including applicable taxes and fees.
If for any reason you are not satisfied with your purchase, you are entitled to a refund within 14 days from the start date of your initial subscription. Refunds for subscription renewals are considered on a case-by-case basis and are granted only if there are no logs of usage since the renewal date. There will be no refunds issued more than 2 day after a subscription renewal. In special cases, we may offer refunds for up to 3 months of subscription fees. Refunds for any payments made more than 3 months ago cannot be granted.
To request a refund, please send an email to contact@buddyx.app with your purchase details and a brief explanation of the reason for your refund request.
Refunds will be processed within 7 business days of receiving your request. Please note that any fees charged by third-party payment processors are non-refundable.
Please note that once the refund period has expired, we are unable to provide any refunds.
7. Cancellation Policy
If you wish to cancel your purchase, please send an email to contact@buddyx.app with your purchase details and a brief explanation of the reason for your cancellation request. We will process your cancellation request within 2 business days of receiving your email.
You can also cancel your subscription by logging into Stripe with your registered email. You can do so by going to Subscriptions menu in the extension, and click on "Manage Subscription".
8. Indemnification
You agree to indemnify, defend, and hold harmless BuddyX, Code by Goat GmbH, its affiliates, and their respective officers, directors, employees, agents, and representatives from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) that arise from or relate to: (i) your use of the BuddyX, Code by Goat GmbH Services, (ii) the content you create or share through the platform, (iii) your violation or alleged violation of these Terms, (iv) your breach of any laws, regulations, or third-party rights, and (v) disputes between you and any third party.
We retain the right to take exclusive control, at our own expense, of any matter where you are required to indemnify us. If this occurs, you agree to fully cooperate with us in asserting any defenses.
This indemnification clause will remain in effect even if these Terms are terminated or your access to the Services ends.
9. Disclaimer of Warranties
BuddyX Services are provided on an "as is" and "as available" basis without any guarantees or warranties, either expressed or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a specific purpose, or non-infringement. We do not warrant or represent the accuracy, reliability, security, completeness, or suitability of the services or any information provided through them.
We do not endorse or guarantee any products, content, or services promoted or advertised by third parties on or through BuddyX. The quality, timeliness, and accuracy of such third-party offerings are solely their responsibility, and we assume no liability for them.
You acknowledge that we are not liable for any errors, omissions, or interruptions in the services, nor for any losses or damages caused by such issues. Furthermore, we bear no responsibility for any third-party platform actions, including account terminations or restrictions resulting from your use of BuddyX Services.
We do not guarantee that the Services will function without interruption, errors, or harmful elements such as viruses. It is your responsibility to implement safeguards, such as antivirus software and data backups, to protect your systems and information.
In jurisdictions where disclaimers or exclusions of implied warranties are restricted, our liability will align with the minimum legal requirements.
10. Limitation of Liability
BuddyX, Code by Goat GmbH will not be held liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Services, even if we have been informed of the possibility of such damages.
In any case, our total liability to you for claims arising from or related to your use of BuddyX Services is limited to the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those regions, our liability will be limited to the maximum extent permitted by law.
We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, labor disputes, power or network outages, government actions, or acts of terrorism or war.
11. Governing Law and Dispute Resolution
These Terms and your use of BuddyX / Code by Goat GmbH Services are governed by and construed in accordance with the laws of Germany.
Any disputes arising out of or relating to these Terms, including questions regarding their validity, interpretation, or enforcement, will be resolved exclusively in the courts of Sendenhorst, Germany. You consent to the personal jurisdiction of these courts and waive any objections based on venue or inconvenient forum.
You agree to waive any right to participate in a class action lawsuit or class-wide legal proceedings against us. All claims must be pursued individually.
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or connected with these Terms or your use of BuddyX Services. This includes, but is not limited to, damages for lost profits, goodwill, data, or other intangible losses, regardless of whether we were advised of the possibility of such damages. Our total liability to you in any circumstance will not exceed the amount you have paid to us for the use of our Services in the twelve (12) months preceding the claim.
Notwithstanding the above, we reserve the right to seek injunctive or other equitable relief to protect our intellectual property rights, confidential information, or other legitimate interests in any court of competent jurisdiction.
12. Miscellaneous
Acceptance of these Terms constitutes a binding agreement between BuddyX, Code by Goat GmbH and the user. These Terms shall apply at all times during and even after your use of the Services.
We reserve the right to modify or update these Terms at any time, at our sole discretion. Changes will take effect upon posting on the BuddyX Website and will apply to all users. It is your responsibility to regularly review the Terms to stay informed of any changes. Continued use of the Services after changes are posted will signify your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, it will be removed without affecting the validity or enforceability of the remaining provisions.
Failure to enforce any provision or right under these Terms will not be considered a waiver of that provision or right. Any amendment or waiver of these Terms must be in writing and signed by us.
You may not transfer your rights or obligations under these Terms to any third party without our explicit consent. However, we reserve the right to assign or transfer our rights and obligations under these Terms freely, including but not limited to in the event of a merger, acquisition, sale of assets, reorganization, or as required by law.
This agreement between Code by Goat GmbH and you remains in effect indefinitely unless otherwise specified in the conditions of a particular service. Either party may terminate the agreement at any time without providing a reason by giving written notice to the other party. Termination does not affect any obligations or liabilities incurred prior to termination.
We may also terminate or suspend your access to the BuddyX Services, with or without cause, and without prior notice. Upon termination, your right to use the Services will immediately cease, and we may deactivate or delete your account and any associated content without liability to you or any third party. Certain provisions, such as Content Ownership and Rights, Indemnification, Disclaimer of Warranties, Limitation of Liability, and Governing Law and Dispute Resolution, will survive termination of this agreement.
